Michael Altaffer and Kris Smith Obtain Defense Verdict in Bad Faith Case
Michael Altaffer and Kris Smith obtained a defense verdict for their client, an insurance company, after an eight (8) day jury trial. Our client was sued by homeowners after a fire loss at a residence. The homeowners disputed the amounts paid by the insurer for the structure claim, personal property claim and additional living expense claim. The plaintiffs sued the insurance company alleging claims for breach of contract, bad faith and punitive damages.
The Plaintiffs initially claimed they were entitled to damages in excess of $1 million. The jury deliberated approximately five (5) hours and returned a defense verdict. In post-trial proceedings, the Court awarded our client costs and attorneys’ fees.
